In this Privacy Policy, we, Smart Home Swiss SA (hereinafter Smart Home Swiss SA, we or us), explain how we collect and otherwise process personal data. This is not an exhaustive description; other privacy policies or general terms and conditions, terms of participation and similar documents may govern specific matters. Personal data means all information relating to an identified or identifiable person.
If you provide us with personal data of other persons (e.g. family members, data of work colleagues), please ensure that these persons are aware of this Privacy Policy and only share their personal data with us if you are permitted to do so and if such personal data is correct.
This Privacy Policy is designed to meet the requirements of the EU General Data Protection Regulation (\u201cGDPR\u201d), the Swiss Federal Act on Data Protection (\u201cFADP\u201d) and the revised Swiss Federal Act on Data Protection (\u201crevFADP\u201d). Whether and to what extent these laws apply, however, depends on the individual case. <\/p>\n

    2. Collection and processing of personal data<\/h3>\n

    We primarily process the personal data that we receive from our customers and other business partners, and from other persons involved, in the context of our business relationship with them, or that we collect from users when operating our websites, apps and other applications.
    Where permitted, we also obtain certain data from publicly accessible sources (e.g. debt enforcement registers, land registers, commercial registers, the press, the internet) or receive such data from other companies within Smart Home Swiss SA, from authorities and other third parties (such as credit agencies, address brokers). In addition to the data about you that you provide to us directly, the categories of personal data that we receive about you from third parties include, in particular, information from public registers; information that we learn in connection with administrative and judicial proceedings; information related to your professional functions and activities (so that, for example, we can conclude and process business with your employer with your assistance); information about you in correspondence and meetings with third parties; creditworthiness information (to the extent that we conduct business with you personally); information about you provided to us by persons in your environment (family, advisers, legal representatives, etc.) so that we can conclude or perform contracts with you or involving you (e.g. references, your address for deliveries, powers of attorney, information on compliance with legal requirements such as anti-money laundering and export restrictions, information from banks, insurers, distribution and other contractual partners of ours regarding the use or provision of services by you (e.g. payments made, purchases made)); information from media and the internet about you (where appropriate in the specific case, e.g. in the context of an application, press review, marketing\/sales, etc.); your addresses and, if applicable, interests and other sociodemographic data (for marketing); data related to the use of the website (e.g. IP address, MAC address of the smartphone or computer, information about your device and settings, cookies, date and time of the visit, pages and content accessed, functions used, referring website, location information). <\/p>\n

    3. Purposes of data processing and legal bases<\/h3>\n

    We use the personal data we collect primarily to conclude and perform our contracts with our customers and business partners and to purchase products and services from our suppliers and subcontractors, as well as to comply with our legal obligations in Switzerland and abroad. If you act for such a customer or business partner, you may of course also be affected in this capacity with your personal data.
    In addition, we process personal data about you and other persons, where permitted and where we consider it appropriate, also for the following purposes, in which we (and sometimes third parties) have a legitimate interest corresponding to the purpose: <\/p>\n

    • Advertising and marketing (including organizing events), provided you have not objected to the use of your data (if we send you advertising as an existing customer, you can object at any time; we will then place you on a suppression list to prevent further advertising mailings);<\/li>\n
    • Market and opinion research, media monitoring;<\/li>\n
    • Asserting legal claims and defense in connection with legal disputes and administrative proceedings;<\/li>\n
    • Preventing and investigating criminal offenses and other misconduct (e.g. conducting internal investigations, data analyses for fraud prevention);<\/li>\n
    • Ensuring our operations, in particular IT, our websites, apps and other platforms;<\/li>\n
    • Video surveillance to safeguard property rights and other measures for IT, building and facility security and to protect our employees and other persons and assets belonging to us or entrusted to us (such as access controls, visitor lists, network and mail scanners, telephone recordings);<\/li>\n
    • Purchase and sale of business units, companies or parts of companies and other corporate transactions and, in connection therewith, the transfer of personal data, as well as measures for business management and, where necessary, to comply with legal and regulatory obligations and internal rules of Smart Home Swiss SA.<\/li>\n<\/ul>\n

      To the extent that you have given us consent to process your personal data for specific purposes (for example, when you register to receive newsletters or for the performance of a background check), we process your personal data within the scope of and based on this consent, provided we have no other legal basis and require one. Consent given can be withdrawn at any time; however, this has no effect on processing that has already taken place. <\/p>\n

      4. Cookies \/ tracking and other technologies in connection with the use of our website<\/h3>\n

      We typically use \u201ccookies\u201d and comparable techniques on our websites that allow your browser or device to be identified. A cookie is a small file that is sent to your computer or automatically stored on your computer or mobile device by the web browser you use when you visit our website. If you access this website again, we can recognize you, even if we do not know who you are. In addition to cookies that are used only during a session and deleted after your website visit (\u201csession cookies\u201d), cookies can also be used to store user settings and other information for a certain period of time (e.g. two years) (\u201cpersistent cookies\u201d). However, you can set your browser to reject cookies, store them only for one session, or delete them prematurely. Most browsers are preset to accept cookies. We use persistent cookies so that you can save user settings (e.g. language, auto-login), so that we can better understand how you use our offerings and content, and so that we can show you tailored offerings and advertising (which may also occur on websites of other companies; however, they do not learn from us who you are, if we even know that ourselves, because they only see that the same user is on their website who was also on a specific page with us). Some cookies are set by us, and some are also set by contractual partners with whom we work. If you block cookies, certain functionalities (such as language selection, shopping cart, ordering processes) may no longer work.
      In our newsletters and other marketing emails, we sometimes, and where permitted, embed visible and invisible image elements. When these are retrieved from our servers, we can determine whether and when you opened the email, allowing us to measure and better understand how you use our offerings and to tailor them to you. You can block this in your email program; most are preset to do so.
      By using our websites and consenting to receive newsletters and other marketing emails, you agree to the use of these techniques. If you do not want this, you must configure your browser or email program accordingly.
      We sometimes use Google Analytics or comparable services on our websites. This is a service provided by third parties that may be located in any country in the world (in the case of Google Analytics, this is Google Ireland (based in Ireland); Google Ireland relies on Google LLC (based in the USA) as a processor (both \u201cGoogle\u201d), www.google.com), which enables us to measure and evaluate the use of the website (not on a personal basis). Persistent cookies set by the service provider are also used for this purpose. We have configured the service so that visitors\u2019 IP addresses are truncated by Google in Europe before being forwarded to the USA and therefore cannot be traced back. We have disabled the \u201cData sharing\u201d and \u201cSignals\u201d settings. Although we can assume that the information we share with Google is not personal data for Google, it is possible that Google may draw conclusions about the identity of visitors from this data for its own purposes, create personal profiles and link this data to these persons\u2019 Google accounts. If you have registered with the service provider yourself, the service provider also knows you. The processing of your personal data by the service provider then takes place under the responsibility of the service provider in accordance with its privacy policy. The service provider only informs us how our respective website is used (no information about you personally).
      We also use so-called plug-ins from social networks such as Facebook, Twitter, YouTube, Pinterest or Instagram on our websites. This is apparent to you in each case (typically via corresponding symbols). We have configured these elements so that they are disabled by default. If you activate them (by clicking), the operators of the respective social networks can register that you are on our website and where, and can use this information for their purposes. The processing of your personal data then takes place under the responsibility of that operator in accordance with its privacy policy. We do not receive any information about you from it. <\/p>\n

      5. Disclosure of data and transfer of data abroad<\/h3>\n

      In the course of our business activities and for the purposes set out in Section 3, we also disclose data to third parties, where permitted and where we consider it appropriate, either because they process it for us or because they wish to use it for their own purposes. This concerns, in particular, the following entities: <\/p>\n

      • Dealers, suppliers, subcontractors and other business partners;<\/li>\n

      • Media;<\/li>\n
      • The public, including visitors to websites and social media;<\/li>\n
      • Competitors, industry organizations, associations, organizations and other bodies;<\/li>\n
      • Acquirers or parties interested in acquiring business units, companies or other parts of Smart Home Swiss SA;<\/li>\n
      • Other parties in possible or actual legal proceedings;<\/li>\n
      • Other companies of Smart Home Swiss SA;<\/li>\n
      • All jointly recipients.<\/li>\n<\/ul>\n

        Some of these recipients are located in Switzerland, but they may be anywhere in the world. In particular, you must expect your data to be transferred to all countries in which Smart Home Swiss SA is represented by group companies, branches or other offices, as well as to other countries in Europe and the USA where the service providers we use are located (such as Hostpoint, foresite). <\/p>\n

        If a recipient is located in a country without adequate statutory data protection, we contractually oblige the recipient to comply with the applicable data protection requirements (for this purpose, we use the revised standard contractual clauses of the European Commission, which are available here), unless it is already subject to a legally recognized set of rules to ensure data protection and we cannot rely on an exception. An exception may apply in particular in the case of legal proceedings abroad, but also in cases of overriding public interests, or where performance of a contract requires such disclosure, where you have consented, or where the data concerned has been made generally accessible by you and you have not objected to its processing. <\/p>\n

        6. Retention period for personal data<\/h3>\n

        We process and store your personal data for as long as it is necessary to fulfill our contractual and legal obligations or otherwise for the purposes pursued with the processing, i.e. for example for the duration of the entire business relationship (from initiation, performance through to termination of a contract) and beyond that in accordance with statutory retention and documentation obligations. It is possible that personal data will be retained for the period during which claims can be asserted against our company and to the extent that we are otherwise legally obliged to do so or legitimate business interests require it (e.g. for evidentiary and documentation purposes). As soon as your personal data is no longer required for the above purposes, it will generally be deleted or anonymized, where possible. For operational data (e.g. system logs), shorter retention periods of twelve months or less generally apply. <\/p>\n

        7. Data security<\/h3>\n

        We take appropriate technical and organizational security measures to protect your personal data against unauthorized access and misuse, such as issuing directives, training, IT and network security solutions, access controls and restrictions, encryption of data carriers and transmissions, pseudonymization, and checks.<\/p>\n

        8. Obligation to provide personal data<\/h3>\n

        In the context of our business relationship, you must provide the personal data that is necessary for establishing and conducting a business relationship and for fulfilling the associated contractual obligations (as a rule, you are not under a legal obligation to provide us with data). Without this data, we will generally not be able to conclude a contract with you (or the entity or person you represent) or to perform it. The website cannot be used either if certain information required to ensure data traffic (such as the IP address) is not disclosed. <\/p>\n

        9. Profiling<\/h3>\n

        We process your personal data partly in an automated manner with the aim of evaluating certain personal aspects (profiling). We use profiling in particular to provide you with targeted information and advice about products. For this purpose, we use evaluation tools that enable needs-based communication and advertising, including market and opinion research. <\/p>\n

        10. Rights of the data subject<\/h3>\n

        Within the scope of the data protection law applicable to you and to the extent provided for therein (as in the case of the GDPR), you have the right of access, rectification, erasure, the right to restriction of processing, and otherwise to object to our processing, in particular processing for direct marketing purposes, profiling carried out for direct advertising, and other legitimate interests in processing, as well as the right to receive certain personal data for the purpose of transferring it to another entity (so-called data portability). Please note, however, that we reserve the right to assert the statutory restrictions on our part, for example if we are obliged to retain or process certain data, have an overriding interest in doing so (to the extent we may rely on this), or need it to assert claims. If costs are incurred for you, we will inform you in advance. We have already informed you in Section 3 about the possibility of withdrawing your consent. Please note that exercising these rights may conflict with contractual agreements and may have consequences such as early termination of the contract or cost implications. In such cases, we will inform you in advance, where this is not already contractually regulated.
        The exercise of such rights generally requires that you clearly prove your identity (e.g. by providing a copy of an ID document where your identity is otherwise not clear or cannot be verified). To assert your rights, you can contact us at the address stated in Section 1.
        In addition, every data subject has the right to enforce their claims in court or to lodge a complaint with the competent data protection authority. The competent data protection authority in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC). <\/p>\n

        11. Changes<\/h3>\n

        We may amend this Privacy Policy at any time without prior notice. The current version published on our website shall apply. To the extent that the Privacy Policy is part of an agreement with you, we will inform you of the change in the event of an update by email or in another appropriate manner.
